The master agreement covering every Heart iQ programme — Sanctuary retreats, online programmes, blended formats, and the Academy professional track.

About this document

These Terms & Conditions cover all programmes offered by Heart iQ.

Heart iQ operates through two legal entities working together. Heart iQ Network LLC (a Wyoming limited liability company, "Heart iQ") is the organisation responsible for programme design, content, facilitation, and participant experience, and is the contracting party for every Heart iQ programme worldwide. New Eden B.V. (a Netherlands private limited company, "New Eden") owns and operates the Heart iQ Sanctuary, the venue in the Netherlands where our in-person retreats and live events take place. New Eden acts as venue host and as payment agent on behalf of Heart iQ for events held at the Sanctuary. New Eden is not a contracting party to your programme agreement.

This document is structured in four parts.

Part I sets out definitions and general provisions that apply to every Heart iQ programme.

Part II covers in-person events held at the Heart iQ Sanctuary in the Netherlands, including retreats, the Academy Live Immersion, and the Sanctuary segments of Blended Programmes.

Part III covers online programmes delivered digitally, including the Heart iQ Experience, the Heart iQ Challenge, the online portion of the Heart iQ Fellowship, and the Academy online practicum.

Part IV covers Academy enrolments under the professional / B2B path for self-employed facilitators, coaches, and other entrepreneurs registering as part of their trade or business.

If any provision in Part II, III, or IV conflicts with a provision in Part I, the part-specific provision applies for that programme.


PART I. DEFINITIONS AND GENERAL PROVISIONS

1. Definitions

In these Terms & Conditions, capitalised terms have the meaning set out below.

Academy means the Heart iQ Academy, the professional facilitator training school operated by Heart iQ. The Academy includes the Academy Live Immersion (an in-person Sanctuary Event) and the Academy online practicum (an Online Programme).

Application Form means the questionnaire a Participant is required to complete when applying for a Programme.

Blended Programme means any Heart iQ programme that combines online delivery with one or more in-person segments. Examples include the Heart iQ Fellowship and the Academy.

Heart iQ means Heart iQ Network LLC, a Wyoming limited liability company, with its registered office at 9450 SW Gemini Dr, Beaverton, OR 97008-7105, USA. Heart iQ is the contracting party for all Programmes.

New Eden means New Eden B.V., a Netherlands private limited company, with its registered office at Sparjeburd 2, 8409 CK Hemrik, the Netherlands, registered with the Dutch Chamber of Commerce under KvK 64284328 (BTW NL855599261B01). New Eden owns and operates the Heart iQ Sanctuary, and acts as venue host and as payment agent on behalf of Heart iQ for Sanctuary Events.

Online Programme means any Heart iQ programme delivered entirely through digital means, with no in-person component. Examples include the Heart iQ Experience, the Heart iQ Challenge, and the Academy online practicum.

Participant means the person who applies for, books, or attends a Programme.

Programme means any Heart iQ offering, including Sanctuary Events, Online Programmes, Blended Programmes, and Academy Programmes.

Programme Fee means the total price for participation in a Programme as published by Heart iQ.

Sanctuary means the Heart iQ Sanctuary, the venue owned and operated by New Eden in the Netherlands.

Sanctuary Event means any Programme or in-person segment of a Programme held at the Sanctuary.

Website means the Heart iQ website at https://heartiq.org and all associated subdomains.

2. Application and acceptance of these Terms

These Terms & Conditions apply to every Programme offered by Heart iQ and to your use of the Website.

By submitting an Application Form, completing a booking, or making any payment for a Programme, you confirm that you have read and accept these Terms & Conditions. As part of the booking process, you will be required to confirm acceptance by checking a box. A copy of these Terms & Conditions will be attached to your booking confirmation email.

The version of these Terms & Conditions that applies to your booking is the version in force at the time Heart iQ confirms acceptance of your application.

Heart iQ may amend these Terms & Conditions from time to time. Amendments do not apply retroactively to bookings already confirmed.

If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full effect, and the affected provision shall be interpreted or replaced with a valid provision as close as possible in purpose and effect to the original.

3. Application process

To enrol in a Programme, you complete the Application Form for that Programme on the Website. You confirm that all information you provide is complete, accurate, and current, including any information about your physical or mental health that is relevant to your participation.

You agree to inform Heart iQ promptly of any material change in your physical or mental condition between the date of your application and the start of the Programme, where such a change may affect your participation.

Heart iQ may, at its discretion, request additional information or arrange an online intake conversation before approving your application. Heart iQ reserves the right to refuse participation in any Programme without being required to provide reasons.

Heart iQ will inform you by email whether your application has been approved, normally within 7 business days. An agreement between you and Heart iQ is concluded at the moment Heart iQ confirms acceptance of your application by email.

If you have previously completed an Application Form for an earlier Programme, Heart iQ may, at its discretion, accept your application based on prior screening or a shortened questionnaire.

4. Nature of Heart iQ Programmes

Heart iQ Programmes are personal and professional development experiences. They include experiential, relational, and group-based work, and may involve embodied, somatic, and trauma-aware modalities. By participating, you acknowledge that the work can be physically, emotionally, and psychologically intensive.

Participation involves inherent personal risks, including emotional discomfort, distress, and the surfacing of difficult memories or emotions. By registering, you accept these inherent risks and confirm that your participation in any aspect of a Programme is voluntary.

Heart iQ Programmes are educational and developmental in nature. They are not medical treatment, psychiatric care, psychological therapy, or any form of regulated healthcare. Heart iQ does not provide medical, psychiatric, psychological, or other licensed healthcare services. Participation is not a substitute for advice or treatment from a qualified medical or mental-health professional. If you are currently receiving care for a physical or mental health condition, you are strongly encouraged to consult with your treating practitioner before enrolling.

Heart iQ does not guarantee any specific outcomes from participation. Statements regarding potential benefits, testimonials shared by previous participants, and other illustrative material are not promises of results.

Programme content may be delivered by Heart iQ facilitators, guest teachers, or other qualified third parties engaged by Heart iQ. Heart iQ is not required to inform Participants in advance of the specific facilitators for any Programme. If a scheduled facilitator becomes unavailable, Heart iQ may substitute a comparably qualified facilitator at its discretion without affecting the validity of these Terms.

5. Liability and indemnification

By registering for a Programme, you acknowledge the inherent risks described in clause 4 and accept responsibility for your own physical, emotional, and psychological wellbeing during and after the Programme.

Heart iQ is liable only for direct damages arising from an attributable failure in the performance of its obligations under these Terms & Conditions. Heart iQ is not liable for indirect, consequential, or special damages, including loss of income, loss of opportunity, reputational damage, or emotional distress, except where such damage results from intent or gross negligence on the part of Heart iQ.

Heart iQ is in no event liable for damage resulting from:

(a) incorrect, incomplete, or outdated information provided by you;

(b) your failure to comply with these Terms & Conditions or with reasonable instructions given during the Programme;

(c) your decision to participate in or abstain from any specific activity within the Programme;

(d) any pre-existing physical or mental health condition;

(e) acts or omissions of other Participants.

Where services are provided by third parties, including New Eden as venue provider, Heart iQ remains the contracting party subject to the limitations of liability set out above. New Eden's liability for venue, accommodation, and meals is governed separately by Dutch law and is not limited by this clause.

Nothing in these Terms & Conditions excludes or limits liability for damages resulting from intent or gross negligence, or for damages that cannot be excluded under mandatory law. If you qualify as a consumer under applicable law, this clause does not limit any consumer protection that mandatory law affords you.

You agree to indemnify Heart iQ against any damage or loss caused by your acts or omissions during or in connection with a Programme, including damage to property, other Participants, or third parties.

6. Force majeure

Heart iQ is not liable for any failure or delay in performing its obligations if such failure or delay arises from circumstances beyond its reasonable control. Force majeure events include, but are not limited to:

(a) acts of God, including earthquakes, floods, severe storms;

(b) fires, power outages, or infrastructure failures;

(c) war, terrorism, riots, or civil unrest;

(d) epidemics, pandemics, or public health emergencies;

(e) government orders, travel restrictions, or border closures;

(f) damage to or closure of the Sanctuary or any other Programme venue;

(g) facilitator illness or injury, or death or serious illness in a facilitator's immediate family.

If Heart iQ is unable to perform a Programme due to force majeure, Heart iQ shall offer you the choice between:

(i) participation in a rescheduled or relocated Programme;

(ii) a credit voucher equivalent to the Programme Fee paid, valid for use at any Heart iQ Programme within 12 months of issue;

(iii) a refund of the Programme Fee paid, in full or in part where part of the Programme has already been delivered.

If a Programme is rescheduled or relocated, you may either accept the new dates or location, or cancel your participation. If you cancel because of a reschedule or relocation due to force majeure, you are entitled to a full refund of the Programme Fee paid, provided you communicate this within 14 days of receiving notice of the change.

Heart iQ is not liable for any indirect or consequential costs you incur as a result of a force majeure event, including travel, accommodation, or other personal expenses. Heart iQ strongly recommends that you obtain travel insurance covering cancellation and disruption for in-person Programmes.

7. Intellectual property

All intellectual property rights in the Heart iQ Programmes, including teaching materials, exercises, methods, audio-visual content, and the Heart iQ name and brand (the "Materials"), are owned by or licensed to Heart iQ.

When you register for a Programme, you receive a limited, non-exclusive, non-transferable right to use the Materials for your own personal, non-commercial development purposes only, in connection with your participation in that Programme.

You may not copy, reproduce, distribute, publish, share, record, create derivative works from, or otherwise use the Materials for any purpose other than your own personal participation, without Heart iQ's prior written consent. Recording any part of a Programme, in audio, video, or any other form, is not permitted unless explicitly authorised by Heart iQ.

Participants enrolled in the Academy under the professional path may receive separate, additional rights to use specific Materials in their own facilitation practice. Those additional rights are set out in the Academy participation agreement and are conditional on completion of the relevant Academy components.

8. Personal data

Heart iQ processes personal data in accordance with its Privacy Policy, available on the Website. By registering, you acknowledge that you have read and understood the Privacy Policy.

For Sanctuary Events, New Eden processes a limited subset of personal data (including invoicing details, dietary requirements, and rooming preferences) in its capacity as venue host and payment agent. New Eden processes this data on the basis of its agreement with Heart iQ and in accordance with its own privacy notice, available at info@neweden.org.

9. Conduct, complaints, and removal from Programmes

Before each Programme, Heart iQ provides Participants with documentation including a code of conduct, consent and boundary frameworks, group agreements, and safety guidelines (the "Participant Documentation"). You agree to read and comply with the Participant Documentation throughout your participation.

Heart iQ may give reasonable instructions to Participants in connection with safety, group dynamics, and the proper conduct of a Programme. You agree to comply with such instructions.

Heart iQ may deny you access to a Programme, or remove you from a Programme with immediate effect, if you:

(a) fail to comply with these Terms & Conditions or the Participant Documentation;

(b) provide incorrect, incomplete, or outdated information;

(c) act in a way that is unsafe, harmful, or seriously disruptive to other Participants, facilitators, or staff.

In the event of denial of access or removal, Heart iQ is not obliged to provide any refund, alternative accommodation, or compensation, except where mandatory law requires otherwise.

For complaints relating to programme content, facilitation, or group conduct, contact Heart iQ at connect@heartiq.org. For complaints relating to accommodation, catering, or venue services at the Sanctuary, contact New Eden at info@neweden.org.

Heart iQ maintains a separate grievance process for ethical concerns and serious complaints, described at https://heartiq.org/ethics/grievance. We aim to acknowledge formal grievances within 5 business days.

10. Information on the Website

Information on the Website is provided for general informational purposes. Heart iQ does not warrant that all information is complete, accurate, or current at every moment. Information shared during Programmes is for educational and personal development purposes and does not constitute medical, psychological, legal, or financial advice.

11. Governing law (general)

The governing law and jurisdiction applicable to your participation depend on the type of Programme. The applicable rules are set out in clause 18 (Sanctuary Events), clause 23 (Online Programmes), and clause 29 (Academy professional track).

If you qualify as a consumer under applicable law, the choice of law and jurisdiction in these Terms & Conditions does not deprive you of the mandatory protections of consumer law in your country of habitual residence.


PART II. SANCTUARY EVENTS

This Part applies to all Sanctuary Events, including:

(a) Heart iQ retreats held at the Sanctuary in the Netherlands;

(b) the Academy Live Immersion;

(c) the in-person live event segment of the Heart iQ Fellowship when held at the Sanctuary;

(d) any other in-person segment of a Blended Programme held at the Sanctuary.

If you book a Sanctuary Event, the provisions of this Part apply in addition to Part I. Where this Part conflicts with Part I, this Part applies for that booking.

12. Entity structure for Sanctuary Events

For Sanctuary Events, Heart iQ Network LLC is the contracting party responsible for programme content, facilitation, and participant experience. New Eden B.V. acts as venue host and as payment agent on behalf of Heart iQ. New Eden provides the Sanctuary itself, accommodation, meals, and ground operations. New Eden is not a contracting party to your programme agreement and is not responsible for programme content, facilitation, or participant experience.

Your invoice and payment receipt for a Sanctuary Event are issued by New Eden B.V., which collects payment on behalf of Heart iQ. The invoice is Dutch-VAT compliant and includes any applicable local tourist tax collected on behalf of the municipality.

Your card statement for a Sanctuary Event will show "NEW EDEN BV" or a similar variant of the New Eden trading name. This reflects the agency arrangement described above.

13. Right of withdrawal for Sanctuary Events

Sanctuary Events are services related to leisure activities provided on a specific date or period. Under Article 6:230p sub e of the Dutch Civil Code (Burgerlijk Wetboek), which implements Article 16(l) of EU Directive 2011/83 (the Consumer Rights Directive), the statutory 14-day right of withdrawal does not apply to your booking of a Sanctuary Event.

This means that once your booking is confirmed, you cannot withdraw from the contract within 14 days as a matter of right. Cancellations are governed by the Cancellation Policy in clause 15 below.

You will be informed of this exemption clearly during the booking process and asked to confirm that you understand it.

14. Programme Fee and payment for Sanctuary Events

The Programme Fee for each Sanctuary Event is published on the Website. Heart iQ may change the Programme Fee for future Programmes at any time. The Programme Fee in force at the time your booking is confirmed is the Fee that applies to that booking.

You may book a Sanctuary Event by paying the full Programme Fee at booking, or by paying a deposit of 25% of the Programme Fee with the balance auto-charged to the same card 30 days before the event start date. Heart iQ or New Eden acting on its behalf will send you a reminder email approximately 5 days before the balance is charged.

Full payment is due no later than 30 days before the start of the Sanctuary Event. For bookings made within 30 days before the start date, full payment is due immediately at booking.

By selecting the deposit option, you authorise New Eden B.V., acting as payment agent on behalf of Heart iQ, to charge the outstanding balance to the payment card you used at booking, on the scheduled balance date.

The deposit is a scheduling convenience and not a payment plan. By booking, you commit to pay the full Programme Fee. Cancelling your participation does not release you from the underlying payment obligation, except as provided in the Cancellation Policy.

If you fail to make full payment by the deadline, Heart iQ is entitled to cancel your booking, provided you have first been given a reasonable additional period to make the payment. In that case, Heart iQ may retain reasonable cancellation costs corresponding to the timing of the cancellation as set out in clause 15.

Payments are processed through Stripe. Stripe acts solely as a technical payment processor and is not a party to your contract.

15. Cancellation Policy for Sanctuary Events

You may cancel your booking at any time by writing to connect@heartiq.org. Cancellations must be made in writing and are effective from the date Heart iQ confirms receipt.

The Cancellation Policy is tiered by Sanctuary Event length, reflecting the different operational commitment cycles of different Programme types.

15.4 Goodwill credit voucher

In its discretion, Heart iQ may offer a transferable credit voucher to Participants who cancel inside the no-refund window. Where offered, the voucher is valid for 12 months from the cancellation date and may be used toward any Heart iQ Programme. The credit voucher is offered as a goodwill gesture and is not a contractual entitlement.

15.5 Basis of the Cancellation Policy

This Cancellation Policy reflects the actual cost commitments Heart iQ and New Eden incur in advance of a Sanctuary Event. These costs include non-recoverable venue capacity, contracted facilitator fees, catering and provisioning commitments, ground operations, and the difficulty of reallocating a place as the event approaches. Longer Programmes require longer Participant planning horizons and have correspondingly longer cost commitment cycles, which is reflected in the tiered structure above.

15.6 Cancellation by Heart iQ for insufficient enrolment

Heart iQ may cancel a Sanctuary Event if the number of confirmed Participants is insufficient to deliver the Programme. In that case, Heart iQ will inform you as early as practicable and offer the choice between:

(i) a place in a rescheduled Programme; or

(ii) a full refund of the Programme Fee paid.

Heart iQ is not liable for personal expenses you may have incurred, such as travel and accommodation, in this scenario. Heart iQ strongly recommends that you obtain travel insurance.

16. Transfers

If you are unable to attend a Sanctuary Event, you may transfer your booking to another person, provided that:

(a) the new participant meets the Programme participation criteria and is approved through the application process;

(b) the transfer is finalised at least 7 days before the start of the Programme;

(c) any financial arrangement between you and the new participant is between the two of you. Heart iQ and New Eden do not refund the original payment and re-charge the new participant.

17. Conduct at the Sanctuary

While at the Sanctuary, you agree to comply with the Participant Documentation, the reasonable instructions of facilitators and venue staff, and the rules of the Sanctuary itself. The Sanctuary is a drug- and alcohol-free venue. You agree to arrive sober and remain sober for the duration of the Programme.

If your conduct is unsafe, harmful, or seriously disruptive, Heart iQ or New Eden may ask you to leave the Sanctuary without refund. Where possible, Heart iQ will attempt to address the matter through conversation before escalating to removal.

18. Governing law and jurisdiction for Sanctuary Events

Sanctuary Events take place in the Netherlands. Payment is processed by New Eden B.V., a Netherlands entity, on behalf of Heart iQ. Accommodation, meals, and venue services are provided in the Netherlands. Accordingly, your booking of a Sanctuary Event is governed by the laws of the Netherlands.

Any dispute arising out of or in connection with a Sanctuary Event shall be submitted to the exclusive jurisdiction of the courts of Leeuwarden, the Netherlands.

If you qualify as a consumer, this jurisdiction clause does not deprive you of the right to bring a claim before any court that has mandatory jurisdiction under consumer protection law.


PART III. ONLINE PROGRAMMES

This Part applies to all Online Programmes, including:

(a) the Heart iQ Experience replay series;

(b) the Heart iQ Challenge;

(c) the online portion of the Heart iQ Fellowship;

(d) the Academy online practicum;

(e) any other Programme delivered entirely through digital means.

For Blended Programmes, this Part applies to the online portion. Part II applies to any Sanctuary segment.

If you book an Online Programme, the provisions of this Part apply in addition to Part I. Where this Part conflicts with Part I, this Part applies for that booking.

19. Entity structure for Online Programmes

For Online Programmes, Heart iQ Network LLC is the sole contracting party. New Eden B.V. has no involvement in Online Programmes. Payments for Online Programmes are processed directly to Heart iQ Network LLC through Stripe and other payment service providers. Stripe and other payment processors act solely as technical payment processors and are not parties to your contract.

20. Right of withdrawal for Online Programmes

Online Programmes are digital content not supplied on a tangible medium. The default rule is that consumers in the EU have a 14-day right of withdrawal under Article 6:230o of the Dutch Civil Code and equivalent provisions across other EU member states.

The right of withdrawal can be expressly waived under Article 6:230p sub g of the Dutch Civil Code (which implements Article 16(m) of EU Directive 2011/83) where:

(a) you provide prior express consent to begin performance during the 14-day withdrawal period;

(b) you expressly acknowledge that you will lose the right of withdrawal once performance begins;

(c) Heart iQ provides confirmation of (a) and (b) on a durable medium.

To begin accessing your Online Programme immediately, you will be asked at booking to:

(i) check a box confirming: "I expressly request that the programme begin during the 14-day withdrawal period."

(ii) check a separate box confirming: "I acknowledge that I will lose my right of withdrawal under EU consumer law once the programme content is made available to me."

Heart iQ will confirm both acknowledgements in your booking confirmation email.

If you do not provide both confirmations, your access to the Online Programme will be delayed until the 14-day period has expired, and you will retain your right of withdrawal during that window.

If you exercise your right of withdrawal after expressly requesting performance to begin during the withdrawal period, you will be liable to pay a proportionate amount for the part of the Programme already performed up to the date of withdrawal.

21. Programme Fee and payment for Online Programmes

The Programme Fee for each Online Programme is published on the Website. Heart iQ may change the Programme Fee for future Programmes at any time. The Programme Fee in force at the time your booking is confirmed is the Fee that applies to that booking.

Payment is due in full at booking, unless an alternative payment plan is offered for a specific Programme.

22. Cancellation and refund policy for Online Programmes

Once you have made a valid waiver of your right of withdrawal under clause 20, and Heart iQ has begun delivering the Programme content (which includes giving you access to course materials, recordings, or live sessions), the booking is non-refundable except as set out below.

If a specific Online Programme has its own published refund policy (for example, a satisfaction guarantee or a money-back window), the published policy for that Programme applies in addition to this clause.

If Heart iQ is unable to deliver an Online Programme as scheduled, you will be offered:

(i) participation in a rescheduled Programme; or

(ii) a credit voucher for use against another Heart iQ Programme; or

(iii) a refund of the Programme Fee paid.

23. Governing law and jurisdiction for Online Programmes

Online Programmes are contracted with Heart iQ Network LLC, a Wyoming limited liability company. Subject to clauses 23.1 and 23.2 below, your contract for an Online Programme is governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.

23.1 Mandatory consumer protection for EU consumers

If you are an EU resident and qualify as a consumer under EU law, the choice of Wyoming law does not deprive you of the mandatory protections of the consumer law of your country of habitual residence (Article 6 of EU Regulation 593/2008, "Rome I"). This includes the right of withdrawal under Article 16(m) of Directive 2011/83 (subject to the waiver mechanism in clause 20), the right to fair contract terms, and any non-derogable consumer protection rules of your country of residence.

23.2 Forum for EU consumers

If you are an EU consumer, you may bring a claim against Heart iQ in the courts of your country of habitual residence. Heart iQ may bring a claim against you only in the courts of your country of habitual residence (Articles 17 to 19 of EU Regulation 1215/2012, "Brussels I Recast").


PART IV. ACADEMY PROFESSIONAL TRACK

This Part applies to participants enrolling in the Heart iQ Academy under the professional / B2B track.

The Academy is a professional facilitator training programme. Most Academy participants are self-employed coaches, facilitators, therapists, or other practitioners, who enrol as part of their trade or profession. For these participants, the Academy is a business expense, not a personal purchase.

24. Two enrolment paths

When you enrol in the Academy, you select one of two paths.

Professional path (B2B). You confirm that you are enrolling for purposes connected with your trade, business, or profession. You provide a business registration number (Dutch KvK, EU VAT, US EIN, UK self-assessment, or equivalent national professional registration). Your invoice is issued in your business name. The provisions of this Part IV apply to your booking. EU and Dutch consumer protection law does not apply.

Consumer path (B2C). You enrol as a private individual. Your invoice is issued in your personal name. The provisions of Parts I, II, and III apply to your booking, depending on whether you are participating in the Academy Live Immersion (Part II), the Academy online practicum (Part III), or both. Consumer protection rules apply where relevant.

If you cannot or do not wish to provide business registration evidence, you must enrol via the Consumer path.

25. Professional path: legal classification

By enrolling under the Professional path, you confirm that:

(a) you are acting in the course of your trade, business, or profession, within the meaning of Article 6:230g(1)(a) of the Dutch Civil Code and Article 2(1) of EU Directive 2011/83;

(b) your participation in the Academy is intended to develop your professional facilitation, coaching, training, or related practice;

(c) you are responsible for any tax treatment of the Academy fee in your jurisdiction, including the deductibility of business expenses and the treatment of VAT.

Because you are not a consumer for the purposes of this contract, the consumer protection provisions of EU and Dutch law, including the 14-day right of withdrawal, do not apply to your booking.

26. Programme structure and payment under the Professional path

The Academy comprises two separate purchases:

(a) the Academy Live Immersion is booked as a Sanctuary Event under Part II, with payment processed by New Eden B.V. on behalf of Heart iQ. The Live Immersion fee covers tuition, food, and accommodation for the in-person component only.

(b) the Academy online practicum is booked as an Online Programme under Part III, with payment processed by Heart iQ Network LLC.

Each component is a separate contract and is invoiced separately. Cancellation, payment, and governing law for each component follow the rules in the relevant Part, modified by this Part IV where applicable.

The Programme Fees for each component are published on the Website. Payment terms follow the rules in clause 14 (Live Immersion) and clause 21 (online practicum).

27. Cancellation under the Professional path

For Professional path Participants, the cancellation policy is as follows.

Academy Live Immersion. The cancellation tiers in clause 15 apply according to the length of the Live Immersion. Because you are enrolled in your professional capacity, the proportionality protections of Dutch consumer law do not apply, and the published cancellation tiers are enforceable in full.

Academy online practicum. The booking is non-refundable from the moment of confirmation. You may transfer your enrolment to a future Academy cohort, subject to availability, at the discretion of Heart iQ.

In exceptional cases involving serious illness, bereavement, or comparable circumstances, Heart iQ may, at its discretion, offer a credit voucher or transfer to a future cohort. This is a goodwill gesture and not a contractual entitlement.

28. Liability under the Professional path

Heart iQ's liability to Professional path Participants is limited to direct damages up to the amount of the Programme Fee paid for the component giving rise to the claim, except in cases of intent or gross negligence.

You are responsible for your own professional indemnity arrangements when applying Academy material in your own practice. Heart iQ does not provide insurance, supervision, or quality assurance for any work you carry out independently of the Academy.

Use of Heart iQ Materials in your own facilitation practice after completion of the Academy is governed by the Academy participation agreement and any associated licensing terms.

29. Governing law for the Professional path

The Academy Live Immersion under the Professional path is governed by the laws of the Netherlands, with the courts of Leeuwarden having exclusive jurisdiction.

The Academy online practicum under the Professional path is governed by the laws of the State of Wyoming, USA, with the state and federal courts of Wyoming having exclusive jurisdiction.

The mandatory consumer protections referenced in clauses 11 and 23.1 do not apply to bookings under the Professional path, because you are contracting in your professional capacity.
